Welcome to DscPicker. These Terms and Conditions ("Terms") govern your use of dscpicker.com and the services we provide. By creating an account or running a draw, you agree to these Terms. If you don't agree, please don't use the service. Questions can go to [email protected].
1. About the service
DscPicker is a Discord comment picker that selects random winners from messages in a Discord channel you choose. We provide the tool; you're responsible for the giveaway you run with it, including its rules, prizes, and compliance with applicable laws.
2. Independence from Discord
DscPicker is an independent product. We are not affiliated with, endorsed by, or sponsored by Discord. "Discord" and related marks belong to their respective owners. You're responsible for making sure your use of our tool complies with Discord's own terms and community guidelines.
3. Eligibility and accounts
To use DscPicker, you must be at least 13 years old, or older where local law or Discord requires it. You're responsible for keeping your account credentials secure and for all activity that happens under your account. Let us know promptly if you suspect unauthorized access.
4. Free trials and subscriptions
New users receive 3 free trial draws. After your trials, continued access to features requires a paid plan. Our current plans are the Creator plan at $5 per month and the Growth plan at $50 per year. Paid plans renew automatically for the billing period you selected unless you cancel beforehand. Prices may change, but we'll give notice of any changes that affect an active subscription.
5. Payments and refunds
Payments are processed securely through a third-party provider. By subscribing, you authorize us to charge the applicable fee for your chosen plan. Because the service is delivered digitally and immediately, refunds are handled on a case-by-case basis. If you believe you were charged in error, contact us at [email protected], and we'll look into it fairly.
6. Acceptable use
You agree to use DscPicker only for lawful giveaways and contests. You must not:
- Use the tool to harass, defraud, or deceive participants
- Run draws that violate any law, regulation, or platform rule
- Attempt to manipulate, reverse-engineer, overload, or disrupt the service
- Resell or redistribute access to the tool without our permission
- Use automated means to abuse free trials or evade plan limits
We reserve the right to suspend or terminate accounts that break these rules.
7. Fair selection and your responsibility
DscPicker uses a cryptographically secure random process so that every eligible entry has an equal chance of being selected. While we take great care to ensure technically fair draws, you remain responsible for defining your giveaway's eligibility rules, communicating them to entrants, awarding prizes, and resolving any disputes with participants. We are a tool, not a party to your giveaway.
8. Availability
We work hard to keep DscPicker running smoothly, but we don't guarantee uninterrupted or error-free service. Maintenance, updates, third-party outages, or factors beyond our control may occasionally affect availability. We may modify or discontinue features at any time.
9. Intellectual property
All content, branding, software, and design on dscpicker.com belong to us or our licensors and are protected by law. You may use the service as intended, but you may not copy, modify, or distribute our materials without permission.
10. Disclaimer and limitation of liability
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including disputes with giveaway participants or any losses connected to a prize. Where liability cannot be excluded, it is limited to the amount you paid us in the preceding three months.
11. Termination
You may stop using DscPicker and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that harms us or other users.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the date above. Continuing to use the service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the applicable laws of the jurisdiction in which DscPicker operates. Any disputes will be handled in accordance with those laws.
